HJC: Statements targeting judges undermine judicial independence

TIRANA, Aug 29 /ATA/ The High Judicial Council responded on Friday to recent statements made by public and private entities against judges, emphasizing that such remarks undermine the independence of the judiciary.

“The High Judicial Council, prompted by recent statements from public and private entities, reiterates that such remarks undermine the dignity and integrity of judges and compromise the independence of the judiciary,” reads the official statement from the Council.

“In every democratic society, judges are the guarantors of equality before the law. Consequently, the exercise of their function must be independent and free from any form of influence, subject only to the Constitution and the laws. In a state governed by the rule of law, the separation and balance of powers is a fundamental principle, and the judge performs their duties independently, assessing facts and interpreting the law, free from any external pressure,” the Council emphasized.

The High Judicial Council calls on all public and private entities to respect the independence of the judiciary, recognizing it as one of the fundamental pillars of the rule of law.

“The only legitimate way to challenge a judicial decision is through the procedural mechanisms provided by law, by filing an appeal with a higher court. Likewise, any complaint or allegation concerning a judge’s conduct or integrity must be addressed to the appropriate institutions,” the Council emphasized.

In accordance with its constitutional responsibilities, the High Judicial Council (KLGJ) expresses full support for all judges and their daily efforts to uphold citizens’ rights and serve the public interest. Furthermore, the Council encourages judges to carry out their duties responsibly and independently, free from any external influence.

“In a rule-of-law state—now nearer than ever to fulfilling its aspiration of European Union membership—an independent judiciary remains the sole guarantee of equal treatment under the law and the delivery of effective justice, one that genuinely commands public confidence,” the statement concludes.
