TIRANA, November 15/ATA/- The Constitutional Court reacted today to the Parliament’s resolution on “Avoiding the Constitutional Crisis with a view to the legitimacy of the Constitutional Court – the imperative duty of the highest state bodies”.
The Constitutional Court of Albania said in its statement that it resolves constitutional disputes and makes its final interpretation and that it is subject only to the Constitution.
“In regard to the Resolution adopted by the Albanian Parliament, the Constitutional Court clarifies that, even after filling in some of the vacancies in its composition, it does not yet have the necessary quorum to consider and decide upon a judicial hearing concerning the requirements forwarded to it. For this reason, it cannot exercise its substantive or jurisdictional powers over resolving the conflict of competences between constitutional powers or bodies, nor those powers related to the constitutional review of acts issued by public authorities, “is read in the statement of the Constitutional Court.
Under these circumstances, the Constitutional Court states that, “As an independent institution, applying the Constitution and its organic law and the legislation in force, as well as the administrative practices followed over the years, in order to ensure the normal conditions for the smooth functioning and well-functioning of its activity, it is taking all the necessary formal administrative steps for the three new members beginning their work after their swearing in front of the President of the Republic. “/p.s./
