Electronic register, travel bans for people suspected of protest violence

TIRANA, Oct 28 /ATA/ – The government on Wednesday approved the creation of a special electronic register for people referred to prosecutors or under investigation for violent offences against public order and safety during public gatherings and demonstrations.

The register will be managed by the General Directorate of State Police and will contain information on individuals for whom police reports submitted to prosecutors document specific acts of violence.

It will include registration details, information on the source of the data, procedural records and updates, as well as identity information obtained through the national civil registry. References to cases, incident dates and any existing restrictive measures will be retrieved from police databases and the ADAM system.

Border and Migration Police will have limited access to the register for border checks and enforcement of legally imposed restrictions. Information will be exchanged through authorised electronic systems, without granting police general access to prosecution records.

Under the decision, border police may administratively refuse an individual permission to leave Albania if an individual check reveals specific information linking them to violent acts during public gatherings or demonstrations, even if no court-ordered measure prohibiting foreign travel has been imposed.

If departure is not refused, border authorities will notify the authorities of the destination country that the individual has been referred to prosecutors in connection with the offences covered by the decision.

The State Police will also notify private individuals and legal entities operating accommodation facilities about people for whom there is specific information indicating involvement in such acts and whose cases have been referred to prosecutors.

The need to retain data on individuals referred to prosecutors must be reviewed within 30 days of registration. Data must be deleted if the competent prosecution authority decides not to initiate criminal proceedings or dismisses the case.

The government said the processing and exchange of information would comply with personal data protection legislation, ensuring confidentiality, restricted access, traceability and proportionality.

The Interior Ministry, the State Police and the National Agency for Information Society have been tasked with implementing the decision.
