Bardhi says failure to enforce Constitutional Court ruling on magistrates’ pay undermines rule of law

TIRANA, Aug 26 /ATA/ The Democratic Party’s parliamentary group chairman, Gazment Bardhi, accused the government and ruling majority of repeatedly refusing to enforce Constitutional Court rulings, describing the situation as a serious risk to the democratic functioning of the state and the separation of powers.

In a social media post, Bardhi addressed the situation regarding the remuneration of judges and prosecutors, stressing that the relevant legal provisions were struck down by the Constitutional Court, effective July 31, 2026.”

Bardhi said that since August 1 the judiciary has been left without a clear legal basis for the remuneration of judges and prosecutors. He also criticized the High Judicial Council for deciding its own salary, describing the move as unprecedented.

He said the decision questions its constitutionality and legal foundation, adding that clashes between institutional competences could be avoided by enforcing Constitutional Court rulings. Bardhi called on the Albanian Parliament to act immediately to address and resolve the situation, citing a responsibility defined by the Parliament’s Legislative Council on May 4, 2026.

The only way to resolve this situation is through full, immediate and unequivocal enforcement of the binding rulings of the Constitutional Court,” he said.

He described Parliament’s inaction and the failure to implement Constitutional Court decisions as a grave violation of constitutional principles and the rule of law.

He stressed that selective enforcement of rulings undermines the rule of law, insisting that implementation is a constitutional obligation, not a political choice.
