TIRANA, July 21 /ATA/ The head of the Special Prosecution Against Corruption and Organized Crime (SPAK), Klodian Braho, took part on Tuesday in a consultation meeting organised by the Parliamentary Committee on Legal Affairs and Public Administration as part of the Post-Legislative Scrutiny (PLS) process.
Braho said that SPAK’s proposals and findings focused on three main areas, starting with the clarification of the legal framework, including issues related to the scope of the law and the regulation of its application over time.
According to Braho, another area concerns strengthening procedural safeguards, particularly for the rights of third parties whose assets may be subject to confiscation under legal provisions without their knowledge or presence at the hearing.
Braho said SPAK had also addressed practical obstacles in asset investigations, including the issue of fees for obtaining official documentation, which he identified as one of the challenges.
“This is not merely a matter of payment, but concerns the way requests for information from the prosecution have been regulated, as they have been treated under a Council of Ministers decision as though they were applications for changes to a property’s status,” he said.
Braho said the report had broadly incorporated SPAK’s input, taking into account the issues raised by the Special Prosecution and, in some cases, further developing them.
“The remaining challenge is to turn the report’s findings into clear and applicable legal provisions. SPAK stands ready to contribute to consultations on further draft legislation that, in our view, requires amendments to this law,” Braho said.
