TIRANA, Jan 9 j /ATA/ The Special Prosecution Against Corruption and Organized Crime has filed a request for trial against the defendants Benet Beci, Adela Ruko, Edlira Mitrushi, Jonid Kazani, Yllka Nishku, Premtim Dauti, and Rudin Gjoni, who are accused of committing the criminal offense of “Violation of Equality of Participants in Public Tenders or Auctions” in complicity.
SPAK announced that, the subject of this investigation is a procurement procedure conducted by the Albanian Power Corporation for the project ‘Strategic Development of the Energy Sector (Research Project)’, with reference number REF-46463-12-18-2019 and a budget ceiling of 69,500,000 (sixty-nine million five hundred thousand) Albanian lek.”
SPAK stated that the investigation was largely initiated based on referrals of documents from the National Bureau of Investigation (BKH).
SPAK announced that the administered documents indicate that, during this procurement procedure, circumstances arose pointing to the criminal offense of violating the equality of participants in public tenders or auctions. The offense is linked to unlawful actions by the head of the contracting authority, members of the procurement unit, and the bid evaluation committee. These actions included setting the budget ceiling, drafting the terms of reference, specifying criteria in the standard tender documentation, and during the bid evaluation phase.
SPAK stated that evidence gathered through special investigative techniques, seized materials from Evis Berberi’s residence, and other investigative actions have revealed key findings in the case.
The defendant Benet Beci, as Administrator of the Albanian Power Corporation and head of the contracting authority, together with members of the procurement unit—Jonid Kazani, Edlira Mitrushi, Yllka Nishku—and members of the bid evaluation committee—Adela Ruko, Rudin Gjoni, and Premtim Dauti—predetermined and created unfair advantages and privileges for the company that won this procurement procedure, “Consulting & Management Albania” sh.p.k.
