Tirana, July 7 /ATA/ Today, the Prosecutor’s Office at the First Instance Court of General Jurisdiction in Shkodër issued a response concerning Prime Minister Edi Rama’s public comments on the decision to refrain from initiating criminal proceedings related to the illegal constructions identified in the Theth area.
The Prosecutor’s Office confirmed that prosecutor Elsa Gjeli’s decision on May 30, 2025, to not initiate criminal proceedings complies with the law, as the alleged facts either do not constitute a crime or clearly do not exist.
The prosecutor’s office concluded that the structures in question are temporary containers, not permanent buildings, and therefore do not qualify as illegal constructions under the Criminal Code or territorial planning law.
Furthermore, according to amended Decision of the Council of Ministers No. 408, dated May 13, 2015, such temporary structures do not require a construction permit, but only a prior declaration. Even the Municipal Inspectorate of Shkodër has classified these cases as administrative violations rather than criminal offenses.
