Xhaçka’s mandate, Bushka: CC decisions are legally binding

TIRANA, April 11 /ATA/ -By Maela Marini/ The MP of the Socialist Party, Klotilda Bushka, presented on Thursday in the plenary session the report of the majority of the Council for Regulation, Mandates and Immunity with the scope, “establishing the invalidity and the termination of the mandate of the MP Olta Xhaçka.”

Bushka said that “we have gathered to address a constitutional procedural issue, we are neither in a political trial, nor in front of a public political prosecutor who asks questions to a member of the Assembly.”
According to her, Olta Xhaçka, through the legal representative, spent 10 hours in the Constitutional Court and answered all the questions and claims of the parties, as well as brought 500 pages of documents supporting her arguments.

“In the end, the Constitutional Court did not rule whether the mandate is compatible or not, but simply dropped the case. Xhaçka has been available to the constitutional justice.

Thanks to the constitutional reforms, duties are separated, justice is independent in its work. You raise here issues that fall into the scope of the independent judiciary’s duties on one hand and the other you criticize us for not supporting the justice reform”, Bushka addressed the opposition MPs.
According to her, the decisions of the Constitutional Court are legally binding and the Constitutional Court is the final authority recognized by law.

“It is not about the mandate of Xhaçka or anyone else. It is about constitutional standards and democratic balances. You cannot use certain issues of constitutional interest to your political advantage. For us, the implementation of constitutional standards is of vital importance,” she said.
