TIRANA, Nov 18 /ATA/ – By I. Vata/- The Democratic Party has filed with the Constitutional Court the request to get yesterday’s decision of parliament overridden, as well as for ascertaining incompatibility of MP Olta Xhaçka’s mandate with Constitution.
In a media statement, the DP MP Agron Shehaj said that the majority turned the Assembly into a shield for the corrupt government.
Shehaj said that “this is a very serious act, and yet, no surprise for us because in these 10 years, this majority has taken advantage of the power to steal and get rich in breach of law using the cards of the Parliament as a shield for their corruption”.
He emphasized that DP will fight to the end the battle with the corruption and embezzlement of this government.
“Minister Xhaçka cannot be Foreign Minister and strategic investor at the same time. She cannot be a member of parliament and the owner of the public beach. Therefore, it is up to the Constitutional Court to rule whether she is in compliance with the law and the Constitution”, Shehaj said.
In yesterday’s plenary session, which ended after midnight, the two reports of the Council for Regulation, Mandates and Immunity were presented.
The DP MP, Gazmend Bardhi, presented the draft report of the democratic parliamentary group, where, among other things, he emphasized that the facts and the legal analysis show that Xhaçka is subject to incompatibility, defined in the Constitution, which should also result in termination of her mandate as a deputy and that the Assembly has the obligation to refer the case to the Constitutional Court, in respect of the previous practice followed before.
The deputy of the socialist parliamentary group, Klotilda Bushka, presented the draft report of the parliamentary majority on the requirements for following the parliamentary procedure for establishing the invalidity and terminating the mandate of the deputy Olta Xhaçka. Among other things, she argued that in respect to what has been presented in the two motion requests and with reference to the constitutional provisions, this is not a case that should be taken to the Constitutional Court.
The report of the democratic parliamentary group was rejected with 21 votes in favor, 73 against and no abstentions, while the report of the socialist parliamentary group was approved with 73 votes in favor, 21 against and one abstention.
