Gërdeci file, Constitutional Court rejects Mediu

TIRANA, July 27/ATA/ The Constitutional Court rejected the appeal of the former minister of defense Fatmir Mediu against the decision of the Special Court of Appeal that accepted the SPAK’s request to reopen the investigations on the Gërdeci file.

Mediu addressed the Constitutional Court with the request “To repeal of decision no. 1106, dated 21.12.2021 of the Criminal College of the Supreme Court, as incompatible with the Constitution of the Republic of Albania”.

In the decision of the Constitutional Court, no. 99 dated 19.07.2022, the College of the Constitutional Court of the Republic of Albania, consisting of: Vitore Tusha, president and Elsa Toska and Sandër Beci, members, on 19.07.2022 took into preliminary consideration request no. 4 (F) 2022 of the Basic Register with applicant Fatmir Mediu.

The object of the request was the annulment of decision no. 1106, dated 21.12.2021 of the Criminal College of the Supreme Court, as incompatible with the Constitution of the Republic of Albania.

The College of the Constitutional Court, after listening to the relator of the case Sandër Beci, examined the request, the attached documents and discussed the case as a whole, decided not to consider the case in the plenary session.

Earlier on, the Special Court of Appeal for Corruption and Organized Crime, with decision no. 205, dated 24.09.2021, has decided the revocation of the decision to suspend the investigations and the return of the acts to the Special Prosecutor to proceed, based on Article 329/c, point 3, of the CPC, since parliamentary immunity at the time of the process raised against the petitioner constituted merely a temporary procedural obstacle for the criminal process, which, being dismissed before the Supreme Court College, with the lapse of the condition, the criminal prosecution resumed. /j.p/p.s./
