TIRANA, December 9 /ATA/ The Disciplinary Commission of the Special Appellate College dismissed today from office Judge of the Appellate College Luan Daci.
The Special Appellate College held on December 7, 2021 the public hearing session of the case against Daci.
The investigating judge of the case, Judge Ardian Hajdari presented to the Disciplinary Commission the report drafted on results of the investigation and its relevant attached acts, which requested to be administered as evidence by the Disciplinary Commission.
After reviewing the report, based on the applicable legislation, the investigating judge asked this Commission to decide on the disciplinary measure of dismissal of the judge under disciplinary proceedings, Luan Daci, according to article 128, point 2, letter “b” of the Constitution.
Daci presented his objections regarding the request of the investigating judge, asking the Disciplinary Commission to dismiss the disciplinary proceedings and not to impose a disciplinary measure, as, according to him, there is no criminal evidence and that the address to Article 128 , point 2, letter “b” of the Constitution, is wrong. Daci stated that he was not under the conditions of a disciplinary violation, referring to Article C, point 16, of the Annex to the Constitution, as well as Articles 16 and 17 of Law 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania ”.
The Disciplinary Commission decided to close the review of disciplinary proceedings after hearing the final inquiries of the parties.
Luan Daci falsified the documentation at the time he applied to become member of the Special Appellate College body. In the documentation submitted at the time by Daci, he also concealed the fact that when he was a judge in Tirana court in 1997, the High Judicial Council, at proposal of Minister of Justice dismissed him from office for violation of the law and disability.
In today’s session, the Special Appellate College announced the decision to dismiss from office Judge Daci. /a.a/p.s./
