TIRANA, Sept 22 /ATA/ Fatmir Xhafaj, Chair of the Parliamentary Committee on Citizens’ Initiatives, Cooperation and Institutional Oversight, reacted today to the measure imposed by the Special Prosecution Against Corruption and Organized Crime (SPAK) against the Director of the State Intelligence Service, Vlora Hyseni.

Responding to opposition MPs, Xhafaj underlined that every institution has duties and responsibilities defined by the Constitution and the law. He stated that institutions exercise their powers in accordance with the law.

“You spoke of institutions, yet in reality each institution has its own duty and responsibility. If the institutions of criminal justice have the constitutional and legal function of prosecution, that is not our role here. Our duty is as lawmakers. It is institutions that carry out arrests, not individuals. Institutions perform their functions, and the competent authority has fulfilled its duty in accordance with the law,” he said.

According to Xhafaj, such developments are an indicator of the functioning of institutions and the strengthening of the rule of law. ‘This is a sign of democratic maturity, a sign of the consolidation of the rule of law, and a clear indicator of the maturity of institutions,’ Xhafaj said.”

Xhafaj added that such situations are common in consolidated democracies, citing the United States as an example. “What we are witnessing today is what routinely happens in the normal world, in democratic countries, in states where the rule of law operates. We see this in the champion of democracy, the United States of America. Such phenomena are normal for a consolidated state, for a state governed by the rule of law,” he said.
