In his correspondence, Bardhi contends that the voting process was conducted in breach of the Constitution and the Rules of Procedure of Parliament. He underscores that Article 17, Paragraph 1 of the Electoral Code provides that “the Commissioner, members of the Regulatory Commission, and members of the CEC shall be elected by Parliament with no less than three-fifths of the votes of all Members of Parliament.”

“According to Article 55, Paragraph 3 of the Parliament’s Rules of Procedure, the relevant draft decisions cannot be considered adopted without this qualified majority. For this reason, and pursuant to Article 61 of the Rules, which stipulates that any vote conducted in violation of the Constitution, the law, or the Rules of Procedure is null and void, we request the annulment of the vote and its rerun,” Bardhi wrote in the letter.

In his letter, Bardhi also draws attention to the vote conducted yesterday during parliamentary proceedings.

Furthermore, the Chair of the Democratic Party Parliamentary Group asserts: “This incident further demonstrates that the opposition’s motion for your dismissal was justified. You lack both the capacity and the integrity necessary to preside over Parliament. You continue to act as if the political directive of Taulant Balla prevails over the Constitution, the law, and the Rules of Procedure of Parliament. You maintain the belief that it is sufficient for Taulant Balla to vote ‘in favor,’ and that parliamentary acts do not require a quorum under the law, as you consider them adopted,” Bardhi emphasized.

The Chair of the Democratic Party Parliamentary Group has requested that the Speaker of Parliament, upon receiving the opinion of the Secretariat for Procedures and Voting, order the immediate repetition of the voting process.
