TIRANA, Feb 16 /ATA/- By Maela Marini/ Prime Minister Edi Rama, also chairman of the Socialist Party, stressed that suspending a cabinet member from office affects the functioning of the institution rather than the individual.

At the Socialist Party parliamentary group meeting, where the proposal to prevent the suspension of constitutional functions was presented, Rama outlined the political and logical rationale behind the initiative.
“The prior speakers mentioned a gap, which I contend lies in the approach of those who have failed to align governance with the spirit of the Constitution and the democratic principle of separation of powers, a standard recognized not only in Europe but worldwide. I am not referring to specific individuals, but to the broader challenges posed by Albania’s underdeveloped democratic culture and its evolving rule-of-law tradition,” Rama stated.

According to Rama, it is not necessary for every detail to be explicitly codified in statutory text when the Constitution’s spirit and provisions clearly establish guidance for all individuals subject to it.

He emphasized that what makes a suspension imposed by a prosecutor or judge during a preliminary proceeding—before the trial of a government cabinet member has even begun—scandalous and indefensible is that the measure affects the institutional function rather than the public official personally.
According to Rama, the functions involved in the initiative are directly connected to the person in office, and suspending a minister disrupts the entire institution, not merely the individual’s duties.

The Prime Minister underscored that the Ministry of Infrastructure and Energy no longer possesses the capacity to submit proposals to the Council of Ministers, as it is not represented by the designated officeholder.

“This alone should suffice to put this unreasonable debate to rest. The fact that there has never been a single instance in European democratic history where a government member has been suspended by a prosecutor or judge should be enough. In no democratic jurisdiction has a cabinet member ever been suspended. Yet, rather than issuing a decision based on constitutional principles, a decision is being made driven by political considerations and the internal needs of individuals seeking to maintain political balance,” Rama stated.

The Prime Minister emphasized that there are members of the Constitutional Court who have never issued a single ruling in favor of the government.
