TIRANA, Dec 28 /ATA/ – By I. Vata/- The Independent Qualification Commission (IQC) announces that the twelve members of the Commission, in cooperation with the backup staff and under the supervision of the International Monitoring Operation (IMO) have moved ahead with the process, delivering in public sessions, but also in the counseling room, 118 decisions during 2022, achieving the objectives set for the examination of the majority of files.

IQC informs that the Commission has carried out the re-evaluation of judges and prosecutors with efficiency, impartiality and professionalism, handing down 604 decisions, from the start of this process until December 27, 2022.

In the press release, the IQC announces that it has carried out the process of transitional re-evaluation of judges and prosecutors for 75% of the total list of 805 subjects.

“This outcome was achieved after reviewing and analyzing the voluminous files, exchanging information with auxiliary institutions, but also carrying out in-depth investigations by the Commission on the subjects of the re-evaluation, based on the criteria laid down in the Annex to the Constitution and law no. 84/2016, “On the transitional re-evaluation of judges and prosecutors in the Republic of Albania.” Until the end of the vetting process, there are still 201 subjects that will be vetted by the Commission. The judicial bodies are committed to move ahead with the re-evaluation process until its completion, within the time line of the constitutional mandate. The re-evaluation of judges and prosecutors is considered to be a process of essential importance also in the light of the negotiations between Albania and the European Union, where the vetting bodies provide a direct contribution with regard to chapter 23 “Judiciary and fundamental rights.” The progress of this process is expected to give fresh impetus to Albania’s ratings on its way to ensure a professional, independent and non-corrupt judicial system,” according to the press release.

“The Independent Qualification Commission has delivered 604 decisions, of which: 248 confirmation decisions for 125 judges, 110 prosecutors, 2 former inspectors at the HJC, 1 inspector at the High Court and 10 assistants/legal advisors; 216 decisions on dismissal from office for 128 judges, 84 prosecutors, 1 inspector at the HJC, 1 inspector at the HJC and 2 legal assistants; 90 decisions on interruption of the process (Article G of the Annex to the Constitution) for 56 judges, 22 prosecutors, 2 ex- inspectors at HJC, 9 legal assistants, 1 former prosecutor; 8 decisions on the termination of the process for 3 judges, 1 prosecutor and 4 legal assistants in the High Court (Article 56 of Law No. 84/2016); 38 decisions to close the process without a final decision for 23 judges, 13 prosecutors, 1 former chief inspector in HJC and 1 former inspector in HJC (Article 95 of the Code of Administrative Procedures and Article 64 of Law No. 96/2016); 4 decisions on the suspension from duty for 3 prosecutors and 1 legal assistant,” same sources say.
