TIRANA, Jan 3 /ATA/ – Amendments approved to Albania’s law on tax procedures introduce new measures to curb the use of cash, formalize the economy and increase transparency in economic transactions, including mandatory point-of-sale (POS) terminals for businesses and stricter limits on cash payments.

Under the revised law, the maximum amount allowed for cash payments between businesses will be lowered to 100,000 leks from 150,000 leks, with the aim of improving transaction traceability and reducing tax evasion by encouraging the use of bank payments.

At the same time, limits are introduced for cash transactions between individuals, self-employed persons and traders or entities when dealing with private individuals, where the value of a transaction exceeds 500,000 leks. The measure is part of broader efforts to restrict the circulation of cash outside the formal financial system.

As part of policies to promote electronic payments, the amendments also require taxpayers engaged in cash-based economic activity to equip points of sale with POS terminals, in line with deadlines set by law.

According to the Finance Ministry, businesses operating in the tourism and transport sectors must comply by May 30, 2026, while the deadline for all other businesses is December 31, 2026.

The amendments also exempt public institutions from late-payment interest in cases where delays in filing or settling tax obligations result from the application of laws or bylaws with retroactive effect, or from final court rulings, aiming to avoid penalties arising from factors beyond institutional control.

In addition, the law introduces administrative sanctions against producers or maintenance providers of fiscal device software who refuse to cooperate with the tax administration, strengthening oversight and enforcement of the fiscalisation system.

The changes also grant individual taxpayers the right to correct their annual personal income tax declaration within six months of submission, with a maximum of two corrections allowed. The deadline for submitting amended declarations is shortened to 24 months from 36 months, in a move aimed at improving accuracy and voluntary compliance.
