The decision, delivered by Judge Miliana Muça, upheld the ruling of the Special Court against Corruption and Organized Crime (GJKKO), which had previously denied Koka’s motion to terminate the security measure, notwithstanding his claim that the statutory three-year period of pre-trial detention in the Fier incinerator case had elapsed.
In December 2021, Koka was remanded in custody in connection with the Elbasan incinerator case, facing indictments for abuse of office, money laundering, and corruption. In 2023, he was sentenced to five years and eight months in jail. Subsequently, in July 2025, the Court of Durrës adjudicated in his favor, granting conditional release in accordance with applicable legal provisions.

In relation to the Fier incinerator case, Koka was sentenced on 23 September 2023 to ten years’ imprisonment. However, in December 2024, the Court of Appeal against Corruption and Organized Crime (GJKKO) ordered that the case be remitted for retrial at first instance. On 21 October 2025, the High Court ruled that the case should be reviewed by the Special Court of Appeal on Corruption and Organized Crime .
Meanwhile, in the case of the Tirana incinerator, on 16 April 2025, he was sentenced by the anti-corruption court to three years’ imprisonment, one year less than the sentence requested by the Special Prosecution. This decision is not yet final.
