TIRANA, Sept 15 /ATA/ – Parliament must legislate on magistrates’ salaries in line with a Constitutional Court ruling, but the court cannot assume powers that belong to the legislature, Justice Minister Toni Gogu said on Tuesday.

“The failure of parliament to act cannot be resolved by taking over powers or assuming other powers that are not provided for by law,” Gogu told parliament’s Legal Affairs and Public Administration Committee.

The committee was reviewing amendments to legislation governing the status of judges and prosecutors, including changes to magistrates’ salaries.

Gogu said the Constitution made parliament responsible for determining the formula and level of salaries through legislation.

He said Constitutional Court decisions must be implemented while respecting the constitutional framework under which the court operates.

Albania’s justice system must also uphold the principles of integrity, accountability and efficiency, Gogu said, describing them as key pillars of the country’s justice reform.

The opposition called for a hearing with representatives of the country’s judicial and prosecutorial institutions before the committee takes a decision on the proposed changes.
