TIRANA, June 30 /ATA/ The government has approved a new draft law on co-ownership in collective housing, aimed at improving the management of communal areas and enhancing the quality of life within urban communities.

The Minister of State for Local Government, Arbjan Mazniku, presented the draft law “On the Administration of Co-ownership in Buildings” to the Committee on Economy and Finance.
Mazniku said that the legislation mandates the establishment of a “co-ownership register” by municipal authorities, serving as an official record that precisely delineates the communal areas and specifies the respective responsibilities of each resident.

A total of 43,200 apartments, representing 40% of all housing units, are located in multi-story buildings, thereby creating co-ownership arrangements. The legislation establishes the framework regulating the coexistence of nearly 40% of the nation’s residents. Numerous daily challenges related to communal living and communication are inherently linked to the management of co-ownership.

“The law establishes the obligation for each building to be issued a joint co-ownership certificate. All elements that are part of the co-ownership are recorded in a specific property certificate,” Mazniku stated.
According to Mazniku, the initiative establishes clear guidelines defining what constitutes co-owned property.

“The initiative mandates that each municipality create a co-ownership register containing the building type, the year of construction, the administrative bodies it has, and the building typology,” Mazniku stated.
Mazniku stated that “each municipality must maintain a register of all buildings.”

According to the minister, the law also “provides for maintenance categories, which until now had been unstructured.”
Mazniku indicated that the reserve fund is allocated across multiple distinct categories.

According to Mazniku, the new law will strengthen the role of municipalities, which will be responsible for maintaining the co-ownership register, and will empower them to intervene to ensure that the elements specified in the register, but not currently enforced, are properly implemented.

“Mazniku stated that the law establishes a responsible structure for the swift and effective resolution of disputes involving amounts up to 800,000 lek. A commission will be set up in each municipality to function as an administrative entity for resolving disputes within this threshold. Individuals retain the right to pursue their disputes in court if an agreement is not reached.”
According to Mazniku, the law is modeled after systems in Italy, France, Germany, and also incorporates elements from Croatia and Slovenia.

Mazniku affirmed that the legislation integrates best practices from countries comparable to ours, alongside those from more developed nations with extensive experience in maintenance, with the aim of identifying mechanisms to establish a more effective and functional framework.
