TIRANA, July 12 /ATA/ The Parliamentary Committee for Economy and Finance approved the law “On the administration of confiscated illegal constructions, with the aim of using them for public interest or social housing, as well as mitigating the social consequences caused.”

Deputy Minister of Finance and Economy, Endrit Yzeiri, said that the draft law aims to regulate and mitigate the social and urban consequences caused by constructions for the purpose of profit in breach of the law on the third parties whose property interests are affected by confiscation of buildings for profit purposes built without a permit or in excess of the construction permit, as well as the community in general.

Also, he emphasized that the law defines the rules for the good administration of confiscated buildings as constructions without permission for the purpose of profit, aiming to increase their value in order to use them for public interest or housing.

But the Democratic Party MP, Jorida Tabaku, stated that recently laws are being written in business offices to protect private interests.

“People from 10 state institutions have worked on this law. This draft law was designed in the building of the Ministry of Finance, Justice, MoIE, in the Prime Minister’s office, in public buildings. These people have invested time, knowledge and their skills ,” said Deputy Secretary General of the PM’s office Elira Kokona.

Kokona guaranteed that this draft law does not protect private interest and has not taken into account anyone’s interest.

Kokona announced that the law aims to fill a legal gap for confiscated buildings that were constructed in excess of the permit.

The Ministry of Finance and Economy Secretary General, Risena Xhaja, announced that there are currently 25 confiscated objects throughout the country, of which 13 objects have exceeded 10% of the construction, which means that of those confiscated in total, 4 objects have been built without a construction permit, and in 7 objects 90% of the construction stock is without a permit.

According to her, currently there are only 9 requests for pre-emption and the fund raised from it is 15 million euros.

The concrete objectives that are intended to be met with the approval of this draft law are the guarantee of sustainable development of the territory, the improvement of planning and construction procedures, the establishment of legal mechanisms to effectively manage confiscated assets, the improvement of the regulatory framework and measures prohibiting constructions without permission, mitigating the social and urban consequences caused by constructions without permission, or in excess of the construction permit, for the purpose of profit, as well as the setup of a public financial fund for the purpose of supporting national policies for territory control.
