TIRANA, Jan  24 /ATA/ – By  I. Vata/ The Special College of Appeal held on Tuesday the public court session of the case pertaining to the appeal of the Public Commissioner against the Independent Qualification Commission related to the subject of the re-evaluation, Enkeleda Osmani (Xhengo).

While outlining the grounds for the appeal about the wealth criterion, the Public Commissioner stated that the subject of re-evaluation, Enkeleda Osmani (Xhengo), has made an incorrect and insufficient declaration that does not reach a convincing level for her confirmation in office.

The Public Commissioner requested the reversal of the Independent Qualification Commission decision no. 275, dated 20.07.2020, and the dismissal of the subject of re-evaluation.

The legal representative of the subject of re-evaluation presented the rejections of the grounds for the appeal and asked the College to assess and take them into consideration during the financial analysis. The legal representative requested the reopening of the judicial investigation of the case, the admission as evidence of some new acts that he presented during today’s session, as well as asked the College to confirm the subject of the re-evaluation, Enkeleda Osmani (Dzhengo), after assessing that she reaches a credible level in the wealth criterion.

After the parties said that they had no other procedural requests, the trial panel decided to close the judicial investigation of the case and invited the parties to present the final conclusions at the next session, on 02.03.2023, at 10:00.

The Special Appellate College held on Thursday the public court session of the case pertaining to the appeal of the prosecutor Petrit Bica against the decision of the Independent Qualification Commission.

His legal representative presented the objections to the decision of the Independent Qualification Commission, no. 506, dated 31.01.2022, which brings to an end the transitional re-evaluation process for the subject of re-evaluation Petrit Bica and prohibits his appointment as a judge or prosecutor of any instance, member of the High Judicial Council or High Prosecutorial Council, High Inspector of Justice or General Prosecutor, for a period of 15 years. ”

The legal representative stated that the case of Bica should have been addressed by the Independent Qualification Commission pursuant to the provisions set out in Article 27 of Law 96/2016 “On the status of judges and prosecutors in the Republic of Albania”, as amended, for early retirement and not as a termination of the revaluation process due to resignation. The subject of re-evaluation stated that the decision of IQC is not based on evidence and law.

The subject of re-evaluation answered several questions of the international observer of the International Monitoring Operation and a question of one of the members of the trial panel about the case under consideration.

After consultation, the trial panel decided to administer as evidence the acts attached to the appeal by the subject of re-evaluation, which are not part of the file of the Independent Qualification Commission, an act submitted during today’s hearing, as well as the acts forwarded by the KPC to the College.

After hearing the final request of the subject of the re-evaluation, the trial panel decided to withdraw to take the final decision, which will be handed down on May 16, 2022, at 13:00.
