TIRANA, Sept 17 /ATA/ The Conference of Charpersons failed to reach agreement on the request submitted by 41 MPs from the Democratic Party Parliamentary Group and the Freedom Party Parliamentary Group, “On the establishment of a Parliamentary Inquiry Committee to examine the legality of the activities of the state‑owned company ‘KAYO’ sh.a., in relation to cooperation agreements, production, import, export and trade of arms, ammunition and military equipment.”

After discussions, the Conference of Chairpersons did not reach understanding and decided to refer the matter to the plenary session.

The head of the Socialist Party’s parliamentary group, Taulant Balla, stated that the request to establish a parliamentary inquiry committee concerning the company “KAYO” sh.a. does not meet the constitutional and legal criteria required for the establishment of such a committee.

According to Balla, from a substantive standpoint the request does not identify a “specific issue,” as required by the Constitution, since the scope of the inquiry has been conceived in overly broad terms and encompasses a range of different matters without clearly defining the concrete facts that should be subject to parliamentary investigation.

Balla argued that the request fails to specify concrete acts, omissions, contracts or timeframes alleged to be unlawful. He maintained that the proposal amounts to a broad review of the company’s activities rather than the investigation of a clearly defined issue of particular public importance.

Balla argued that the eight points outlined in the inquiry’s scope are heterogeneous, ranging from contractual relations and military production and trade to budgetary funds, suspicions of arms trafficking and NATO obligations. He maintained that such breadth prevents a clear definition of the inquiry’s boundaries and fails to meet the constitutional standard of a “specific issue.”

Balla stressed that a parliamentary inquiry committee cannot be set up merely to collect information in search of possible irregularities, but must be grounded in prior data and concrete indications that justify parliamentary oversight.

He also voiced concern about the potential overlap between such an inquiry and the investigations already launched by the Special Prosecution regarding audio recordings published in the media.
