Initially, on December 13, the Constitutional Court returned Basha’s request for documentation completion, but after it was submitted again to the court, the latter decided not to legitimize and review it.

The Constitutional Court underlines that the Democratic Party does not have a direct interest in the case, so its request filed with the Constitutional Court is not legitimate.

The prime minister, the president and 1/5 of the MPs are among the entities that can submit a request to the Constitutional Court for a certain issue. In this case, the request submitted by Lulzim Basha as chairman of the DP is not legitimate because the agreement is not in the interest of the political party.

The agreement with Italy was suspended after the Constitutional Court reviewed the request signed by 30 deputies of the Bardhi-Berisha group who described it as unconstitutional.
