TIRANA, Sept 15 /ATA/ – Justice Minister Toni Gogu stated Tuesday that the Constitutional Court decisions must be implemented, but at the same time the constitutional order on which it has acted must be respected.
Justice Minister made the remarks during a hearing as lawmakers at the Committee on Legal Affairs and Public Administration reviewed the draft law “On the status of judges and prosecutors in the Republic of Albania,” with focus on the issue of magistrates’ salaries.
According to Gogu, the essential issue is who should determine the salary formula and the amount of each salary in the Republic of Albania, emphasizing that the Constitution determines that this competence belongs to the Assembly through law.
“The Constitutional Court ruling requires parliament intervention to draft a new bill. The inaction of parliament cannot be resolved by taking over powers and by taking over other powers different from the law,” Gogu said.
The Minister emphasized that the salary system in the Republic of Albania must respect the principles set forth in the Constitution and the law. He singled out integrity, accountability, and efficiency as three important principles of justice reform.
Opposition lawmakers called for a hearing with institutions and organizations representing the justice system, regarding the situation created regarding magistrates’ salaries.
