Failure to implement Constitutional Court decisions fuels political crises

TIRANA Oct 21 /ATA/ Democratic Party MP Jorida Tabaku emphasized today the importance of preserving the core integrity of the Constitutional Court.

Speaking at the panel on constitutional justice during the conference “30 Years of Partnership and Progress: Albania, the Council of Europe, and the Venice Commission,” Tabaku stated, “Constitutional justice represents the noblest effort undertaken by the most responsible minds in politics and the state to guarantee citizens protection from abuse, defend them against tyranny, and uphold their dignity in the face of power.”

“At its core, it is the principle that no one is above the law—neither the majority nor those in power. I believe this is also the foundation of our democracy,” Tabaku emphasized.

The Democratic MP also highlighted that the Venice Commission has been the most valuable partner of Albanian democracy.

“A partner that, over 35 years of democratic development and 30 years of Albania’s membership in the Council of Europe, has helped maintain institutional balances and strengthen the rule of law,” Tabaku stated.

She also emphasized that the majority has continued efforts to influence the composition and integrity of the Constitutional Court.

Tabaku expressed concern that, despite constitutional guidance, decisions are often made through force rather than proper procedure. She criticized the removal of a Constitutional Court member representing the minority as a direct interference in the court’s composition.

Tabaku warned that political pressure and double standards threaten constitutional justice and stressed the need to protect the core integrity of the Constitutional Court.

Tabaku cited examples of this dangerous logic, including the termination of Constitutional Court mandates, defying the institutional hierarchy regarding the President’s decrees, and refusing to implement court decisions clearly.

Tabaku highlighted that failure to implement Constitutional Court decisions has frequently triggered political crises, reflecting a blatant disrespect for both the Court and the Constitution.
