Constitutional Court rejects small parties’ complaint against Electoral Code

TIRANA, December 24 /ATA/ The Constitutional Court rejected as unfounded the complaint of the small parties regarding the Electoral Code.

The small parties requested the annulment of the amendments to the Code, considering them to be incompatible with the Constitution.

The Court considered the parties’ claims for the violation of the right to vote, in two aspects, the right to be elected and to elect, provided for in Articles 45 and 64 of the Constitution, related to the principle of equality under the law.

The Court did not find any violation of the principle of equality under the law for both political parties, organizations and individuals in the two aforementioned aspects, the right to be elected and to elect. According to the analysis of the claims of the applicants and the provisions under review, it resulted that the legal provisions are addressed in the same way to all electoral subjects and voters, therefore, consequently, they do not differentiate between them in the voting process.

With regard to the applicants’ claim regarding the procedure of approving the law, the Court did not reach the required number of votes for decision-making.

At the end of the examination of the case, the Court decided by majority vote to reject the request. /m.m/a.f/p.s./
