Constitutional Court squashes opposition MPs’ request for Berisha case

TIRANA, Dec 20 /ATA/ The Constitutional Court squashed the request of the opposition MPs on Sali Berisha case.

On December 14, the representatives of the DP Reestablishment Commission, Oerd Bylykbashi, Ivi Kaso and Franci Nuri, filed a request to the Constitutional Court regarding the “conflict of competences between the judiciary and the legislative over the immunity of deputies.”

The representatives of Reestablishment in the Constitutional Court filed the request after the security measure against Sali Berisha was changed by SPAK from mandatory appearance to pretrial detention.

“The request aims to resolve the conflict of competences between the institution of the Assembly on the one hand and the judiciary on the other, in terms of depriving and/or limiting the freedom of a deputy, in all forms, when these freedom-restricting measures are taken by the judiciary without asking, without obtaining the authorization of the Assembly in advance”, it is stated in the request filed by the representatives of Reestablishment.
