TIRANA, June 25 /ATA/ The Constitutional Court has reacted over the decision to take the issue of the June 30, 2019 elections to the Venice Commission.
In its reaction, the Constitutional Court states that “the non-constructive debate of recent days does not serve the climate of faith, on the contrary it could be perceived as an attempt to use it in political debates presented in the guise of legal discourses to prejudge its decision-making regarding the merits of the case and as an interference with its independence. ”
The Constitutional Court has closely followed the discussions triggered by its decision-making dated June 23, 2021 to request amicus curia from the Venice Commission to review the case on the electoral process of June 30, 2019.
The Constitutional Court, expressing its concern about misinterpretations and misinformation regarding this decision-making, states that “it is its institutional duty to inform as following. This decision is intermediate and is based on article 44 / b of law no. 8577, dated 10.02.2000 “On the organization and functioning of the Constitutional Court of the Republic of Albania,” added in the framework of the changes of the justice reform. ”
The CC clarifies that “the object and the issues on which it was decided to seek this opinion are different from the issues addressed in the previous opinions of the Venice Commission, which the Constitutional Court undoubtedly always takes into account. “Moreover, in the multitude of cases handled since the re-functioning of the Constitutional Court, this is the only case in which it used this instrument.”
“The Constitutional Court has previously addressed the Venice Commission, as a specialized body of the Council of Europe with in-depth expertise in constitutional law and with a valuable contribution to the activity of this Court in matters of special importance. The case on the electoral process of 30.06.2019 is of a unique nature and the consultation with specialized bodies was deemed necessary by this Court, “according to the CC.
The Constitutional Court, in its latest press release, underlined the importance of unconditional respect for its rulings and expressed the conviction that the exercise of the activity of this Court in a climate of trust by anyone would serve to strengthen its authority as an independent constitutional body.
