Çela: Chief prosecutors who keep open cases in “pending file” drawers should be held accountable

TIRANA, May 27 /ATA/ – By I. Vata/ The High Prosecution Council held on Thursday a hearing session with Prosecutor General, Olsian Çela, on the activity of the prosecution system during 2020.

Çela stated that all chief prosecutors who keep open cases in pending file drawers should be held to account.

He drew the attention of the HPC members that the three-month delegations for the chief prosecutors of the districts were not based on the performance of the relevant prosecution and urged more cooperation between the institutions since, according to him, the Prosecutor General has no information on the performance of chief prosecutors in the judicial districts.

There are chief prosecutors who think like the previous predecessors. They forget that there is an institutional relationship that they must respect. If chief prosecutor keep open cases in pending file drawers, they should be held to account for violation of the prosecutors’ independence. We have information on how these registers are being handled. We ask for data and the data are scarce. We do not have a clear picture of the situation, so we have asked HIJ to conduct a thematic inspection of compliance with these requirements,” Çela said.

Cela also spoke about a gap in the system. “What is happening?” While we seek the engagement of the HIJ inspector the days go by. Performance may not be subject to HIJ controls. It controls individual performance. What about the office performance? Nobody. There is a gap in the system today. “Establishing this connection between Prosecutor General and the chief prosecutors, involving the Prosecutor General in the process, the HPC will definitely decide to dismiss them, this is beyond discussion, but the commitment of Prosecutor General in making this assessment is important,” he said.
