TIRANA, December 30 /ATA/- Former Democratic Party MP Oerd Bylykbashi is skeptical that the Constitutional Court can come up with a decision on the June 30 elections or changes to the Electoral Code.
During an interview for ATA, Bylykbashi said he is skeptical about the functioning of the Constitutional Court arguing that it is not functional if there are not 9 members, as 3 members belong to the ruling majority and are elected by the Parliament.
Regarding the Constitutional Court on the legitimacy of the June local elections, Bylykbashi said that we should first talk about the functionality of the Constitutional Court.
“The Constitutional Court makes final decisions with 5 people,” he said.
Speaking about the June 30 elections, Bylykbashi said that we will have 7 members of the Constitutional Court, where three of them are controlled with an iron fist by the majority through the appointments made by the Parliament and there is no doubt that they will act in the way the majority requires. That is why they are there, that is why the constitutional rules for the establishment of the Constitutional Court have been violated.
“We must hope that 1 of the three members of the majority has the high constitutional legal conscience to break away from the majority and accept what all Albanians saw on June 30 that there was no election as required by the Constitution, but a vote under the pressure of a small number of voters who were militants or the administration and who were ordered to vote. This is the reason, according to the Constitution, the court is functional when it has only 9 members”, he said.
Bylykbashi told ATSH that, “For the Constitutional Court to have 9 members, the Supreme Court must be established, which is far away. It is up to the Supreme Court to fill the 9 members of the Constitutional Court by giving it 3 members and only then can we have hope. ”/p.s./
