Meta sends back to parliament law on Criminal Code

TIRANA, Aug 6 /ATA/ – By I. Vata/ – President of the Republic Meta has sent back to parliament for review the law on Criminal Code.

The institution of President of the Republic notes that, as part of exercise of his powers, President Ilir Meta has decided to send back to the Assembly for review this law on the grounds that some issues, the current provisions of the Criminal Code do not guarantee proper prevention or punishment of some negative acts or inactions that have occurred in society, which need to be defined as criminal offenses, or some others provided for in Criminal Code that need to carry a more severe criminal punishment.

“On the other hand, during the examination, it was found that certain specific provisions of the law that have been amended or added add ambiguity to the formulation of some of their paragraphs; are not in harmony or in some cases overlap with other provisions of the Criminal Code, causes which may lead to erroneous application in practice or misinterpretation resulting in violation of constitutional principles and legal certainty, ”he argues.

Likewise, President Meta argues that the review finds that the formulation of some provisions of the Criminal Code, as amended by Sections 3, 6, 7 and 11 of the law, contain issues that violate the principle of the application of the norm effectiveness, jeopardizing the implementation and interpretation in practice, for lack of clarity, which would require either their amendment very soon, or necessitate jurisprudence to make clarification.
